No Limits Shop terms and conditions

i. No Limits (South) is a registered charity in England and Wales, no 1088835 and a company limited by guarantee, no 04183173.

ii. Our registered office is located at 35 The Avenue, Southampton, SO17 1XN.

i. These terms apply to any consumer (persons, organisations, businesses or similar) that is purchasing goods or services through No Limits’ online shop at nolimitshelp.org.uk/shop.

ii. You must be a resident of the UK, or your organisation or business must be based in the UK to make a purchase through our shop.

iii. We may make changes to these terms and conditions at any time by updating the terms published on our website. The terms published at the time or an order will apply to that order.

i. By placing an order through our online shop, you are offering to purchase a product that it subject to the terms and conditions outlined here.

ii. You will enter into a legally binding contract with us at the point that you receive confirmation of your order from us.

iii. The contract is governed by these terms and conditions. These terms and conditions override any arrangement with any third party you may have made.

i. All orders are final and cannot be amended other than through returns and exchanges.

ii. After you place your order, you will receive an order confirmation, detailing your order:

a. Your order number
b. The item(s) which you have purchased
c. The cost and quantity of each item(s)
d. The total price of the order, including the delivery charge
e. Your payment details

iii. We reserve the right to cancel any orders made if we find you do not live in the UK.

iv. Any transactions completed for orders cancelled by No Limits will be refunded. Please allow up to 14 days for the refund to appear in your bank account.

i. All orders are subject to availability.

ii. All stock in our shop has been counted and inputted and will automatically show as out of stock when stock level reached zero.

iii. If, for whatever reason, you are able to and do purchase a product which is out of stock, we will email you to let you know and issue a full refund including delivery costs if a transaction has been completed.

i. The descriptions and images of our products are set out on our online shop.

ii. Some products may differ slightly in colour to the images on our website, depending on the settings and device that you are using.

Products are not to be bought for commercial or business use, or purchased for resale purposes.

i. All pricing is set out on our online shop.

ii. All prices are in pounds sterling (£ / GBP).

iii. VAT is not charged on any product or service – No Limits is not VAT registered.

iv. Prices for products and services may change at any time.

i. We take payment through Stripe.

ii. Stripe’s Consumer Terms of Service at stripe.com/gb/legal/consumer apply to all consumers making a purchase on our online shop.

i. Delivery costs are applied to the heaviest weighing item in your order.

ii. These costs are set by No Limits based on the Royal Mail parcel weight.

iii. Once your order has been delivered ie arrived at the delivery address, the products are no longer the responsibility of No Limits and we are not liable to you if they are damaged or stolen from this point onwards and no refunds, returns or exchanges will be permitted for goods that are damaged or stolen after delivery.

iv. The above clause does not affect your legal rights if the products are faulty or incorrect.

i. Under your consumer cancellation rights, you have 14 days, starting the day after your order is delivered to request a refund.

ii. Once you let us know you would like to return the item for a refund and the return is accepted by us, you have 14 days to send the item back to us.

iii. Items sent back to us without a refund having first been requested will not be refunded.

iv. All returns must be addressed to: No Limits Shop, 35 The Avenue, Southampton, SO17 1XN.

v. If your order has not been returned and received by No Limits within the 14 day window, no refund shall be given.

vi. Item(s) must be returned for a valid reason, being:

a. The product is faulty, damaged (or has been in transit) or is incorrect/misdescribed.
b. The product does not fit.
c. The product is no longer needed.

vii. We will cover return postage for items applicable to clause ‘11(vi)(a)’.

a. If we are covering return postage of your item, we will send a pre-paid return shipping label to the email you used to purchase the item.

viii. We will not cover return postage for items applicable to clauses ‘11(vi)(b)’ and ‘11(vi)(c)’.

ix. Items must be returned to us in a new and unused condition with any tags.

x. If upon return, we find your item has been used or opened, no refund will be processed, or we may make a reasonable deduction. You will be notified of this decision.

xi. We will issue your refund to the same payment method you used at purchase.

xii. Refunds will be provided within 14 days of the day after we receive proof you posted the item or we receive your returned item, whichever comes first.

xiii. If you wish to exchange an item, for example because you wish to have a different size, please contact us at fundraising@nolimitshelp.org.uk to start this process. We will not cover the cost of your postage in this instance.

i. Any bulk purchases are ordered from our suppliers with the desired quantity after purchase from our online shop has been completed.

ii. As we order materials for bulk purchases on an on-demand basis, refunds will not be accepted for these items unless:

a. The items are faulty or damaged
b. The quantity delivered is lower than the quantity you ordered

iii. In the instances of clauses ‘12(ii)(a)’ and ‘12(ii)(b)’, we will work with the supplier to amend your order and ensure you receive correct and working items of the correct quantity.

iv. If for whatever reason, you are unable to be provided with the correct and working items to the quantity ordered, you will be issued with a refund as per the details outlined in clause 11.

We are not liable to you if we fail to comply with these terms because of events beyond our reasonable control.

Any information you provide to us will be handled in accordance with our Privacy Policy available here: nolimitshelp.org.uk/privacy-policy.

No third parties have rights to enforce or override these terms.

i. If you are unhappy with the product(s) you have received, please contact us at fundraising@nolimitshelp.org.uk.

ii. Complaints will be handled in line with our complaints policy, available here: No-Limits-Complaints-Policy-2024.pdf

i. These terms and your rights are not able to be transferred to anyone else. We may transfer our rights under these terms to another business without your consent, but we will notify you of the transfer and make sure that your rights are not affected.

ii. If any clause of these terms becomes illegal, invalid or unenforceable, the legality, validity or enforceability of any other clause of these terms will not be affected.

iii. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. Please also note that we may seek injunctive or other appropriate relief in any country or region if you have violated or threatened to violate our intellectual property rights and/or the intellectual property rights of a third party.
